Weiner & Sand Files FLSA Action Against Gem Shopping Network, Inc.

On May 3, 2018, Weiner & Sand LLC, on behalf of its client George David Burks II,filed a lawsuit in the United States District Court for the Northern District of Georgia against Gem Shopping Network, Inc.  According to the lawsuit, Gem Shopping Network violated the Fair Labor Standards Act when it terminated Mr. Burks in retaliation for his protected complaint about violations of the law.  In addition, Mr. Burks alleges in the lawsuit that Gem Shopping Network failed to properly calculate his and other similarly situated sales representatives overtime rate, and its failure to properly calculate their overtime rates deprived them of compensation to which they were entitled under the FLSA.  The case is Burks, et al. v. Gem Shopping Network, Inc., Civil Action Number 1:18-cv-01952-CAP in the United States District Court for the Northern District of Georgia.
